<p>This comment period encompasses revisions to (2) two policies, FH C170 “Endowed Chairs and Named Professorships” and FH C305 “Emeriti Faculty,” and a new proposed policy, FH Policy C190 &quot;Letter of Academic Title.&quot;</p>
<p>The proposed revisions to FH C170 “Endowed Chairs and Named Professorships” include adding a reference to the collective bargaining agreements and clarifying the differences between selection procedures for internal and external candidates.</p>
<p>The proposed revisions to FH C305 “Emeriti Faculty” are to add minimum requirements for eligibility (a minimum of 5 years at UNM in good standing), require status be requested within 3 years after retirement from UNM, include procedures for requesting status, and clarify rights and responsibilities.</p>
<p>The proposed new policy FH Policy C190 &quot;Letter of Academic Title&quot;  was drafted based upon guidelines from the College of Arts and Sciences and reflects best higher education practices and/or policies from other colleges and universities. It includes input from UNM academic and research administrators and the Academic Freedom and Tenure Committee.</p>

<p>The FH Policy E10: Classified Research Policy has not been revised since March 13, 1973, and revisions are needed to comply with federal laws and regulations. This proposed revised policy was developed by the Faculty Senate Research Policy Committee (RPC) in conjunction with UNM’s Facilities Security Officer who is responsible for supervising and directing security measures necessary for implementing applicable federal requirements. The Faculty Senate Policy Committee (FSPC) reviewed the proposed policy revision and worked with the RPC on any necessary changes.</p>

<p>The UNM Conflict of Interest Offices and the Offices of the Vice President for Research recommended changes to Faculty Handbook Policy E110 “Conflict of Interest in Research” to comply with new federal and state regulations. The Faculty Senate Research Policy Committee and Faculty Senate Policy Committee reviewed the recommendations and made changes where appropriate. Below is a summary of the proposed changes:</p>
<ul>

<p>Indicates that Conflict of Interest (COI) disclosure is also required when there is an appearance of COI and/or a conflict of commitment.</p>
</li>
<li>
<p>Clarifies disclosure requirements and procedures and impacts on research expenditures.</p>
</li>
<li>
<p>Clarifies the role of COI Committee(s) and their interaction with the UNM COI Offices.</p>
</li>
<li>
<p>Clarifies existing options for management of COI and provides additional options.</p>
</li>
<li>
<p>Adds definitions for:</p>
<ul>
<li>Financial Conflict of Interest</li>
<li>Conflict of Commitment</li>
<li>Conflict Management</li>
<li>Reporting of Research</li>
<li>Clarifies the definition of Significant Financial Interest</li>
</ul>

<p>The Faculty Senate Information Technology committee has recommended changes to the
committee’s charge detailed in Faculty Handbook Policy A63.5 “Information Technology
Committee. The Faculty Senate Policy Committee reviewed the recommended changes which are summarized below:<br />
• Voting membership of the committee has been updated to include a UNM Staff Council
member and to remove the requirement for one faculty member to be from the Research
Policy Committee.<br />
• Ex-officio committee membership has been updated to include Health Sciences Center
representatives.<br />
• Committee membership language has been moved from the Policy Statement section to the
Procedures section of the Policy and references to the Business Council structure removed.</p>

<p>This proposed policy was developed by the Industrial Security Office to assist UNM researchers in meeting federal regulations pertaining to the export of certain commodities and/or information to persons and entities outside the U.S. as well as foriegn nationals inside the U.S., for reasons of national security or protection of trade.  The proposed policy encompasses and expands on the President's memo that was issued in 2018, which currently govern export control regulations and is included for reference.</p>
<p>These regulations apply to sponsored research, non-sponsored research, international travel, international
collaboration, purchasing, property accounting and disposal, material transfer agreement’s, non-disclosure
agreements, confidential disclosure agreements, I-129 petitions, and transactions with certain foreign
countries, entities, or individuals.</p>

<p>Currently, D75 “Classroom Conduct” is listed in the Faculty Handbook as an information item. Due to the
significant nature of D75, the Policy Committee has determined it should be classified as a policy. In
addition, faculty have requested greater authority and guidance on appropriately addressing disruptive
classroom conduct/behavior.</p>
<p>In addition to placing D75 in the new policy format, the proposed changes to D75 are highlighted in red in
the attached draft and are described below:</p>
<ul>
<li>Require the course syllabus to include expectations for appropriate conduct and consequences for
disruptive behavior.</li>
<li>Describe a progressive approach for addressing disruptive behavior.</li>
<li>Address mandatory reporting of hate/bias/bullying or Title IX violations.</li>
<li>Document interventions and disruptive behavior.</li>
<li>Authorize faculty to include unexcused absences due to disruptive behavior in consideration of
dropping a student from a course.</li>
</ul>

<p>•Policy Statement – added 2.1 to have a streamlined process for addressing regulatory or legally mandated changes to policy.</p>
<p>•Procedures Section – reordered the Faculty Handbook sections to ensure that the most important information is at the top of the policy and clarified which sections are “above the line” requiring full approvals and which are “below the line” requiring limited approvals.</p>

<p>A proposed revision of Policy C215 “Parental Leave” developed by the Faculty Senate Policy Committee (FSPC) was sent to the campus for a review and comment period ending April 22, 2024. The FSPC reviewed 17 comments received and developed additional changes to address the comments. Due to the significance of these changes, a revised draft is being sent out for a second comment period. The additional changes are highlighted in green in the attached draft and are described below:</p>
<p>•Corrected Applicability Section to change tenured to eligible faculty since this leave benefit is not limited to tenured faculty.</p>
<p>•Clarified which faculty titles qualify for parental leave. The Policy lists the categories of titles and refers the reader to the Office for Academic Personnel website for specific individual titles.</p>
<p>•Changed the level at which procedures and guidelines are developed from departmental to college/school.</p>
<p>•Indicated that additional accommodations beyond Parental Leave are limited to existing alternatives such as Leave without Pay.</p>

<p>The proposed revision of Policy C215 “Parental Leave” was developed by the Faculty Senate Policy Committee. In addition to placing the policy in the new Faculty Handbook format, the proposed changes include:</p>
<ul>
<li>Require that paid parental leave count toward the faculty member’s Family Medical Leave (FML) entitlement and clarify that if parental leave and FML run concurrently the faculty member will be provided full relief from all duties. This aligns with the CBA, UAP Policy 3415 for UNM staff members, and U.S. Department of Labor Guidelines.</li>
<li>Extraordinary circumstances such as multiple births/adoptions or events involving special-needs children may necessitate additional leave and/or flexibility and shall be referred to the Provost/EVPHS, or their designees, for a determination. Refer to Policy C280 “Leave Without Pay.”  This aligns with current CBA language.</li>
<li>Change policy to state: If both parents are faculty members, each is eligible for parental leave and will be reimbursed at their full salary whether taken consecutively or concurrently. This aligns with a recent MOU pertaining to the CBA.</li>
<li>Clarify which faculty are eligible for parental leave and add postdoctoral fellows to those faculty eligible. This proposal is endorsed by both the Provost and the Executive Vice President for Health Sciences.</li>
<li>Add definitions for semester and full salary.</li>

<p>This fall the Academic Freedom and Tenure Committee (AF&amp;T) sent a proposed interim policy which will create the faculty title Practitioner-Educator to faculty for review and comment. Thank you to all who provided feedback during the first comment period. AF&amp;T reviewed the comments received and made changes where appropriate. To allow faculty to review and comment on these subsequent changes, AF&amp;T is sending the proposed interim policy out for an additional 15-day review and comment period. These subsequent changes are highlighted in purple in the draft and are summarized below:</p>
<ol>
<li>
<p>The Clinician-Educator section introduced the term “equivalent doctoral degree.”  Commentors requested a definition for this term. A definition was added in the Definitions Section which includes a list of degrees that qualify as equivalent doctoral degrees.</p>
</li>
<li>
<p>In the Practitioner-Educator section the term “terminal degree” was used as criteria for the title. Commentors asked for clarification of a terminal degree. This section has been expanded to clarify the required credentials to qualify for Practitioner Educator and deletes the use of the term “terminal degree.”</p>
</li>
<li>
<p>Commentors also requested definitions for “healthcare professionals” and “patient care” and definitions for these two terms were added to the Definitions Section of the policy.</p>
</li>
<li>
<p>Commentors asked about procedures for reclassification in accordance with this Policy. Language was added to the Procedures section stating that “colleges and schools will develop written procedures approved by their voting faculty pertaining to reclassification in accordance with this Policy, Faculty Handbook policies, and UNM hiring policies.”</p>
</li>
<li>
<p>Commentors expressed concern that this title could result in current faculty being moved out of their tenure track or Clinician-Educator positions. This is not the intent of the policy.  This policy aligns UNM titles with nationally recognized practices and offers promotion opportunities, thereby increasing faculty rights for current and prospective non-tenure track faculty.</p>

<p>Last Spring, the Faculty Senate Policy Committee sent a proposed revision of Faculty Handbook Policy C80 “Faculty Assigned Duties, Commitments, and Availability to Students” to the campus for review and comment.  The Policy Committee reviewed the comments received and made changes where appropriate.  The changes were made to ensure proper notification to students and allow departments determine the minimum hours required and the modality. <p>The proposed Policy B3.1 “Clinician-Educator and Practitioner-Educator Faculty Titles” has been developed and approved by the Academic Freedom and Tenure (AF&amp;T) Committee to address a concern raised by the Health Sciences Center pertaining to accreditation, recruitment, and retention issues for faculty in healthcare professions such as physician assistants and dental hygenists who hold terminal degrees in their field of study.  Currently at UNM these faculty carry the titles of lecturer, senior lecturer, or principal lecturer and are only eligible for lecturer ranks.  At most colleges and universities these faculty, although not tenured, are eligible for the ranks of instructor, assistant professor, associate professor, and professor.  To address this situation, AF&amp;T is proposing the creation of the title of Practitioner-Educator which would not be tenured but would be eligible for the ranks of instructor, assistant professor, associate professor, or professor.</p>
<p>The Practitioner-Educator title is modeled after the Clinician-Educator title which is not tenured but is eligible for the ranks of instructor, assistant professor, associate professor, or professor.  The major difference between these two titles relates to the types of degrees required.</p>
<ul>
<li>The Clinician-Educator title is used for health professionals with a MD degree, a Ph.D. degree, or an equivalent doctoral degree.</li>
<li>The Practitioner-Educator title is used for health professionals who possess the terminal degree in their field of study but do not possess a MD degree, a Ph.D. degree, or the equivalent doctoral degree.</li>
</ul>
<p>The first phase of implementation of the proposed Policy B3.1 is limited to language necessary to establish the new title. More detailed policies are being developed which will address policies and procedures pertaining to reviews, promotions, and academic leave for Practitioner-Educators, but these policies require detailed input and review by faculty and will take some time to develop.  When these draft policies have been developed and approved by AF&amp;T, they will be sent to faculty for review, comment, and approval.<br />

<p>Last Spring, the Academic Freedom and Tenure Committee (AF&amp;T) sent a proposed revision to Faculty Handbook Policy C200 “Sabbatical Leave” to faculty for review and comment. AF&amp;T has reviewed the comments received and made changes where appropriate. A clean copy and highlighted version, with subsequent changes noted in purple text, can be accessed below.</p>
<p>A summary of the subsequent changes made to the policy draft are as follows:</p>
<ol>
<li>In the Applicability Section: added reference to the Collective Bargaining Agreement.  Although the intent is for this Policy to closely align with the collective bargaining agreement, there may be some differences and this applicability needs to be clarified.</li>
<li>In the Policy Statement Section: added a subsection pertaining to the effective date of the proposed policy changes and indicating they will not be retroactive.</li>
<li>In the Options Subsection: added an option that allows a faculty member to propose for consideration an alternative but equivalent time and salary option.</li>
<li>In the Restrictions, Subsection 7.1.: added language specifying how deferrals will be documented.</li>
<li>In the Procedures Section:
<ul>
<li>Subsection 1.:  Added language pertaining to department chair and dean responsibilities and provide a clarification on deferrals.</li>
<li>Subsection 3:
<ul>
<li>Clarified that all faculty may submit applications up to 18 months in advance.</li>
<li>Removed the differentiation between HSC and other faculty pertaining to application deadlines.  The differentiation pertaining to application deadlines is between 9-month and 12-month faculty.</li>
</ul>
</li>
<li>Subsection 6:  Propose deletion of this section because it does not seem applicable to tenured faculty, since those faculty will have base salaries funded by UNM.</li>
</ul>

<p>The draft Faculty Handbook Policy E30 “Research Data Management” is a new policy proposed
and developed by the Faculty Senate Research Policy Committee. The team developing this
proposed policy was led by Karl Benedict, Chair of the Research Policy Committee; and included
Grace Faustino, Research IT Liaison, Vice President for Research; and members of the IT Research
Technology Advisory Board. The Policy is designed to provide UNM researchers with the
information and resources they need to comply with research data management laws, agreements,
and regulations throughout the research lifecycle. The Policy describes rights and responsibilities
concerning access, use, sharing, privacy, security, confidentiality, maintenance, storage, retention,
and disclosure of research data.</p>

<p>The Academic Freedom and Tenure Committee (AF&amp;T) has reviewed the current Sabbatical Leave policy and is recommending changes to reflect best practices in higher education, current UNM processes and procedures, and align with Collective Bargaining Agreement Unit 1.  The Policy is being revised to:</p>
<ol>
<li>Added a Policy Rationale Section and a paragraph to the Policy Statement Section to align with the new format of policies in the Faculty Handbook.  This added language aligns with the intent of the current Sabbatical Leave policy.  It also clarifies the types of academic activities that can qualify for sabbatical.</li>
<li>Eligibility Subsection: Propose removal of the restriction that a sabbatical will not be granted to subsidize graduate work or work on advanced degrees.  This reflects the value that a specific advanced degree may have in advancing a faculty member’s academic scholarship and professional development and enhance their contribution to UNM.</li>
<li>Options Subsection: added language to indicate that part-time faculty are eligible for a sabbatical that is prorated for their FTE.  This reflects current practice. It clarifies the time frame when a faculty member can apply for sabbatical. In addition, it clarifies that a faculty member may supplement their salary while on sabbatical.  This is common practice at other institutions.</li>
<li>Restrictions, Subsection 1:  Added language that states, “if it is necessary for a faculty member to defer a sabbatical, the duration required for eligibility for a subsequent sabbatical will be reduced by the length of the deferral.” This aligns with Collective Bargaining Agreement Unit 1 and creates equity across UNM, especially for faculty in small departments that can be negatively impacted due to limited resources and reflects best practices at other colleges and universities.</li>
<li>Procedures Section:
<ul>
<li>Delete the sections that place a limit on the number of sabbaticals that can be granted.  These sections highlight such practice in small departments.  We researched current practice at 26 institutions (big, small, public, private): 21 placed no limitation on the number of sabbaticals granted; 5 placed limitations on the number of sabbaticals granted, of those only 2 placed limitations by department, the other 3 placed the limitations at the institution level, and one clearly stated, “Requests for leaves from faculty members of small or large departments shall receive equal consideration.” AF&amp;T adopted this language.</li>
<li>Subsection 4:  Clarify the procedure differences between main campus and HSC and between nine-month and twelve-month faculty.</li>
<li>Subsections 5, 6, &amp; 7:  Add language reflecting current practices at UNM and clarifying eligibility for annual leave accrual for twelve-month faculty taking a sabbatical.</li>
</ul>

After due deliberation, the Policy Committee recommends adding the following language to Policy F100:</p>

<p>Agreements reached by collective bargaining will hold precedence over any element of this Policy for faculty members covered by a collective bargaining agreement. <p>Changes to Policy C70 “Confidentiality of Faculty Records” are proposed to:</p>
<ul>
<li>Policy Rationale: Differentiate between information in the “Faculty Personnel Files” and information that is maintained by UNM administration for reporting and/or documentation purposes.</li>
<li>Policy Statement: Add language to address members in a bargaining unit.</li>
<li>Section 1.2: Add language to address concern raised above in the Policy Rationale section.</li>
<li>Section 2.1: Change language to align with bargaining unit language that states 10 working days as opposed to without reasonable delay.</li>
<li>Sections 2.4 and 2.5: Add to incorporate language in the bargaining agreement that seems appropriate to all faculty.</li>
<li>Section 2.6: Add to affirm that AF&amp;T and the University Secretary may have access to Faculty Personnel Files when an issue is appealed to AF&amp;T.</li>
<li>Related Documents: Add all applicable policies.</li>
<li>Procedures: Add a table that shows the allowable Faculty Personnel Files, what’s in them, and where they are housed.</li>

<p>The Policy is being revised to:</p>
<ul>
<li>Align main campus and HSC appeal processes for graduate and professional students as requested by HSC and the Office of University Counsel. This revision removes one extra appeal step for HSC students and has the endorsement of the leadership at HSC.</li>
<li>Address graduate student complaints, reservations, and reluctance to initiate the first two informal steps (3.2.2 and 3.2.3) of the grievance process because they view the steps as placing them back in a situation that is the root of the alleged grievance. Others have noted conflicts of interest, whereby the faculty member might also serve as the graduate director and/or chair (addressed in section 3.3). The revised draft contains solutions that were proposed and approved by the Associate Dean of Graduate Studies and the Policy Committee.</li>
<li>Update the title of the Office of Equal Opportunity (OEO) to Office of Compliance, Ethics, and Equal Opportunity (CEEO).</li>

<li>Adds a level of discipline, “Disciplinary Probation,” as an intermediary step between censure and suspension without pay, based on an AAUP faculty discipline document.</li>

<p>In 2015 and 2016, changes were made to the Student Grievance Procedures to align them with the UNM Administrative Policy 2740 “Sexual Misconduct.” These changes resulted in discrepancies between Policy D175 in the Faculty Handbook and the Student Grievance Procedures posted in the Pathfinder. The Department of Justice requested that both documents be reviewed and brought into alignment. The Faculty Senate Policy Committee appointed a task force consisting of faculty, student, and administrative representatives to review and recommend changes to D175. Because Policy D176 addresses graduate student grievances, Policy D175 was restructured to apply only undergraduate students. The revised policy also clarifies appeal rights, and deletes Dean of Student procedures which will be published in the Pathfinder as a supplement to Policy D175. When the revision to D175 is approved, the Student Grievance Procedures posted by Dean of Students will be aligned with D175.</p>
<p>Currently grievance information pertaining to graduate and professional students is divided between D175 and D176. Because D175 is being revised to only apply to undergraduate students, D176 has been expanded to include all student grievance policies pertaining to graduate and professional students in one policy. D176 is also being revised for the reasons stated above for D175.</p>

<p><a title="D170: Student Attendance" class="shared-bookmark shared-bookmark--link" href="https://handbook.unm.edu/d170/">Policy D170</a> has not been revised since its inception, and the Policy Committee was asked by the Committee on Governance and student leaders to conduct a comprehensive review of the policy, review policies from other institutions, and recommend changes to bring it up-to-date to reflect current practices, laws, and regulations. The proposed revision describes absences that normally qualify as excused absences, some of which are defined in federal laws and regulations that address military obligations, disability, pregnancy, and religious observations. The revised Policy also provides the process for reporting such absences and completing missed assignments and exams. The revised Policy places the authority to excuse an absence with the instructor, but also provides an avenue for a student to request reconsideration by the college or school dean.</p>
